1. About these terms
These terms and conditions ("Terms") govern use of the website at elleem-advisory.co.za ("the Site"), operated by ELLE EM Advisory ("we", "us", "our"), founded by Letoya Mxotwa and based in Johannesburg, South Africa. By using the Site, purchasing a resource-library product, or engaging our advisory services, you agree to these Terms.
2. Advisory services
Strategy, AI transformation, leadership development, board advisory, research and Sports & Athlete Advisory engagements are proposal-based and delivered under a separately signed engagement letter or statement of work agreed directly with the client. Where anything in an engagement letter conflicts with these Terms, the engagement letter takes precedence for that engagement. Booked sessions (Discovery Call, Strategy Session, Executive Coaching Session, Corporate Consultation) are governed by these Terms together with the booking confirmation issued at the time.
3. Digital resource-library products
Toolkits, frameworks and other digital products sold through the Resource Library are licensed, not sold outright. Purchase grants the buyer a personal, non-transferable licence to use the product for their own individual professional development. Each file is personally watermarked with the buyer's name, email address and a unique licence code at the point of download. Reproducing, redistributing, reselling, sharing a download link, or otherwise making a licensed file available to anyone who has not purchased it, is not permitted.
4. Books
Books by Letoya Mxotwa (see Books) are sold separately from the Resource Library, in either digital or printed format. A digital book is licensed on the same personal, non-transferable basis as clause 3 above, delivered as a reading link tied to the buyer rather than a downloadable file, and is not permitted to be shared or redistributed. A printed book is a physical copy of the published work, packed and posted by hand; ownership of the physical copy transfers to the buyer on delivery, but the intellectual property in its content remains with the author as set out in clause 5. 5. Payments
Payments are processed securely through PayFast. Prices are listed in South African Rand (ZAR) and include any applicable taxes unless stated otherwise. A secure, personally licensed download link is provided automatically once payment has been confirmed as complete. See our Delivery Policy for full delivery details.
6. Intellectual property
All content on the Site, including frameworks, methodologies, written material, toolkit content, book content and site design, is the intellectual property of ELLE EM Advisory or its founder and is protected by copyright. Nothing in these Terms transfers ownership of that intellectual property to any buyer or client.
7. Acceptable use
The Site may not be used to attempt unauthorised access to its systems, to scrape or bulk-extract content, or for any unlawful purpose. We reserve the right to restrict access where these Terms are breached.
8. Confidentiality
Advisory engagements, and coaching and board work in particular, are treated as confidential from the outset. Specific confidentiality terms for an engagement are set out in the relevant engagement letter.
9. Limitation of liability
Our advisory work provides professional judgement, analysis and recommendations; it does not guarantee a specific commercial, financial or organisational outcome. To the extent permitted by law, ELLE EM Advisory's liability in connection with the Site, a digital product, a book, or an advisory engagement is limited to the amount paid for that specific product or engagement. Nothing in these Terms limits liability that cannot lawfully be limited.
10. Changes to these terms
These Terms may be updated from time to time to reflect changes to our services or legal requirements. The version in effect is the one published on this page at the time of use.
11. Governing law
These Terms are governed by the laws of the Republic of South Africa.
